From the last paragraph...

"FWC URGES THE COURT TO DISMISS ALL COUNTS WITH PREJUDICE, ARGUING THE COURT IS WITHOUT JURISDICTION TO ADDRESS THE ISSUES IN THE COMPLAINT. FWC FURTHER ARGUES THAT PLAINTIFFS ARE WITHOUT A MEANS WITH WHICH TO ADDRESS THEIR COMPLAINT...

...THIS COURT CANNOT AGREE THAT OUR SYSTEM OF GOVERNMENT IS SO HARSH AS TO BIND THE HANDS AND GAG THE MOUTHS OF THOSE WHO BELIEVE THEY HAVE BEEN WRONGED. DESPITE THE URGING, THIS COURT DECLINES TO DO SO."

In my own words... Fishing For Freedom.

For those of you who do not understand the first two sub-headings... Essentially, the FWC attempted to have our case thrown out of court with no ability for us to bring forth the assertions within our complaint again. The FWC further stated that the courts have no jurisdiction to decide what is right and wrong in our case. And the most puzzling assertion that the FWC made was that commercial fishermen/women, whose lives they completely control, have no due process right what-so-ever to question whatever the seven FWC commissioners deem to be a RULE... Even when the rule clearly violates the Amendment, Supreme Court Opinion, harms the environment, economy and citizens... All at the same time.

The FWC's arrogance and refusal to obey Article IV, Section 9 of the Florida Constitution and get away with it since 1999 is astounding! Since 1999, Article IV, Section 9 of the Florida Constitution has MANDATED that the FWC establish "adequate due process." As we have protested for well over a decade, "THERE IS NO DUE PROCESS." Judge Jackie Lee Fulford clearly spells out this FWC stance in the last paragraph of her order. So, due to their own argument, no longer can any FWC commissioner or staff member lie to the Legislature claiming that commercial fishermen/women have "adequate due process."

We have pushed the FWC into a corner after a decade and a half of court battles until their true colors are all they have left to fight with. They can no longer back up their rules with ANY logical reasoning what-so-ever since we have irrefutably proven that we have always told the truth and they have lied in every aspect from due process to the science of it all. Exposed for what they are, an autonomous, out of control agency that have kept fishermen on the "back of the bus" for well over a decade, the Judge refused to honor their argument, essentially telling the FWC that this is the United States of America....And that we don't operate like that in this country.

The FWC have until the 29th of February to answer our counts. This will be interesting because if it goes to trial. From the evidence I've been informed about, some FWC officials would be advised to start searching the employment ads in the Tallahassee Democrat.
