We are in the initial phase of framing our case for Federal Court. We have a battery of attorneys and are seeking additional groups to join our case as principal plaintiffs and/or as "Friends of the Court."

Understanding of the Separation of Powers

“Separation of Powers, the doctrine and practice of dividing the powers of a government among different branches to guard against abuse of authority. A government of separated powers assigns different political and legal powers to the legislative, executive, and judicial branches. The legislative branch has the power to make laws—for example, the declaration of what acts are to be regarded as criminal. The executive branch has the authority to administer the law—primarily by bringing lawbreakers to trial—and to appoint officials and oversee the administration of government responsibilities. The judicial branch has the power to try cases brought to court and to interpret the meaning of laws under which the trials are conducted.” Encarta.

Now... A few quick facts about the Imperious FWC:

The Legislature can not even review FWC rules.
FWC rules are, “tantamount to a statute.”
The Judicial Branch can not question the FWC’s “wisdom.” (Or lack thereof)
The Governor may only appoint or remove commissioners.
There is a complete lack of Separation of Powers.

Additional Information

For ten years, the FWC have refused to adhere to the mandate of the legislature and the citizens to establish “adequate due process” under Article X, Section 16 of the Florida Constitution. The FWC have not only failed to create “adequate due process” for citizens to challenge bad rules that affect their lives, they have also refused to obey the standards of FS 370.025 which are STILL mandated by the Florida Legislature in FS 370.093 (6) and verified by the Florida Supreme Court in 2003.

The lack of FWC constitutional due process is so bad, that the Chief Judge Edwin Browning Jr. of the 1st DCA in Tallahassee called the FWC “Imperialists” and stated that the FWC posed a danger to the average citizen. In addition, the Chief Judge warned about the possibility of this cancerous form of government, the Imperialist FWC, spreading to other forms of government.

In his written opinion, the Chief Judge was extremely disturbed at the fact that the FWC did not have to justify their alleged “rational basis,” in a recent case where the FWC’s alleged “rational basis” completely non-existent and idiotic. During the verbal part of the court case, the Chief Judge asked the FWC, “Can your commission just do anything, no matter how irrational?” The FWC attorney’s reply was that, “if the FWC SAYS it’s rational, then that’s all they have to do.”

The dive industry have also witnessed this total lack of Constitutional Due Process. Their attorney, Bob Harris, has told the Legislature how the FWC went over to the Bahamas to obtain a single affidavit from a single “expert witness.” Simply because the FWC found a single expert to agree with their position, the courts threw the dive industry’s case out.

As a result of the lack of Constitutional Due Process and the complete violation of the Separation of Powers Doctrine, corruption… and abuse of our citizens, environment and economy have taken place year after year. We are going to put an end to this corruption.
